1. Agreement to These Terms
These Terms and Conditions ("Terms") govern your use of getforged.ai and related FORGE websites, events, communities, and services — including our AI accountability calling and text-messaging programs (together, the "Services") — operated by OMH Agency, Inc., doing business as FORGE by OMH Agency ("FORGE," "we," "us," or "our"), located at 1112 Clark Ave, Billings, MT 59102.
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you are 18 or older and able to enter into a binding agreement.
3. What the Services Are
FORGE provides a faith-driven growth and accountability community for entrepreneurs. Depending on what you sign up for, the Services may include community membership, in-person and virtual events, live and recorded training, and subscription programs featuring scheduled accountability phone calls and related text messages from an AI accountability partner (such as Selah).
4. Important Disclaimers — Not Professional Advice
The Services — including all calls, messages, and content from our AI accountability partners — are provided for personal development, motivation, and entertainment purposes only. They are not, and are not a substitute for, medical care, mental health treatment, counseling, therapy, or legal, financial, tax, or investment advice. Our AI partners are software, not licensed professionals, pastors, or counselors.
If you are experiencing a mental health crisis or thinking about harming yourself, do not rely on the Services. Call or text 988 (the Suicide & Crisis Lifeline, available 24/7 in the US) or call 911 in an emergency.
5. Accounts and Accurate Information
When you create an account or sign up, you agree to provide accurate, current information — including the phone number and email used for scheduling and notifications — and to keep it up to date. You are responsible for activity under your account and for keeping your login credentials secure.
6. Calls and Call Recording
Membership calling programs involve scheduled phone calls from an AI accountability partner. By enrolling in a calling program, you consent to receive these calls at the number you provide and you consent to those calls being recorded and transcribed so we can provide the service — for example, documenting your check-ins and sending you follow-up messages. Calls are placed on weekday mornings at the time you select; you can reschedule or pause them through your account or by contacting us.
7. Text Messaging (SMS) Terms
- We send text messages only with your express consent, collected through an unchecked-by-default checkbox on our forms or at checkout. Consent is not a condition of any purchase, and providing a phone number is optional on our sign-up forms.
- Message types include account and service messages (call confirmations, missed-call notifications, post-call follow-ups, scheduling, and account notices) and, with separate consent, occasional marketing and event messages.
- Message frequency varies; for members of the daily calling program, approximately 1 to 3 messages per weekday.
- Message and data rates may apply, depending on your mobile plan.
- Reply STOP to any message to opt out at any time. Reply HELP for help, or email selah@getforged.ai. Opting out of service messages may limit our ability to deliver parts of a calling program you purchased.
- Mobile carriers are not liable for delayed or undelivered messages.
- See our Privacy Policy for how we handle your mobile information. Your mobile information is never shared with third parties or affiliates for marketing or promotional purposes.
8. Memberships, Billing, and Cancellation
- Prices, billing frequency, trial or introductory terms (including any earn-back or credit offers), and what is included in each program are disclosed on the checkout page at the time of purchase. The checkout terms for a specific offer control if they differ from this section.
- Paid subscriptions renew automatically at the disclosed rate until you cancel. You can cancel at any time through your account or by emailing selah@getforged.ai; cancellation takes effect at the end of the current billing period, and no further charges will be made after that.
- Except where required by law or stated in a specific offer, payments already made are non-refundable.
- We may change pricing for future billing periods with advance notice; continuing to use the Services after the change takes effect means you accept the new price.
9. Acceptable Use
You agree not to misuse the Services, including by:
- using them for any unlawful purpose;
- harassing, threatening, or harming other members or our team;
- attempting to interfere with, overload, probe, or gain unauthorized access to our systems, forms, or other members' information;
- submitting false information or impersonating another person; or
- copying, reselling, or reverse-engineering any part of the Services.
We may suspend or terminate access for violations of these Terms.
10. Community Standards
FORGE community spaces (events, groups, and online communities) are built on respect and candor. We may remove content or members that undermine the safety or integrity of the community. Member information shared inside the community is for community purposes only and may not be harvested or used for unsolicited marketing.
11. Intellectual Property
The Services and all content we provide — including the FORGE and Selah names and logos, training materials, recordings, and website content — are owned by OMH Agency, Inc. or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use content we make available to you as part of the Services. You may not reproduce or distribute it without our written permission.
If you give us feedback or suggestions, you grant us the right to use them without restriction or compensation.
12. Third-Party Services and Links
The Services rely on third-party providers (such as telephone carriers, messaging platforms, and payment processors) and may link to third-party websites. We are not responsible for third-party services or content, and your use of them may be governed by their own terms.
13. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that calls or messages will be delivered at any particular time — AI systems and phone networks can and do fail. We do not guarantee any particular personal or business result from using the Services.
14. Limitation of Liability
To the maximum extent permitted by law, OMH Agency, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Services. Our total liability for any claim arising out of the Services will not exceed the amount you paid us for the Services in the 12 months before the event giving rise to the claim (or $100 if you have not paid us anything). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless OMH Agency, Inc. from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services.
16. Termination
We may suspend or terminate your access to the Services immediately, without prior notice, if you breach these Terms. You may stop using the Services and cancel your membership at any time. Sections that by their nature should survive termination (including Sections 11, 13, 14, 15, and 17) survive.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Services will be resolved in the state or federal courts located in Yellowstone County, Montana, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at selah@getforged.ai and give us 30 days to work toward an informal resolution.
18. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Material changes will be posted on this page, and continued use of the Services after changes take effect constitutes acceptance. If you do not agree to updated Terms, stop using the Services.
